1. Introduction and Acceptance of Terms

Welcome to Step Rival ("Step Rival," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Step Rival mobile application (the "App") and any related services (collectively, the "Service").

By downloading, accessing, registering with, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Service.

IMPORTANT: These Terms include a mandatory arbitration provision and a waiver of class actions. Please review Section 17 carefully.

2. Description of Service

Step Rival is a mobile application that tracks your steps, walking distance, and estimated calories burned using Apple HealthKit and motion data with your permission. It includes goals, streaks, leaderboards, rivalries, friends, teams, team chat, quests, achievements, pet battles, pet races, summons, rewards, virtual currencies, collectibles, store items, battle passes, rewarded ads, and other social or progression features.

3. Eligibility and User Accounts

• Minimum Age: You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service. Users in the European Economic Area must be at least 16 unless parental consent is provided.
• Account Registration: You must create an account via email, Google Sign-In, or Sign in with Apple to access core features.
• Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
• Accurate Info: You agree to provide and maintain accurate, current, and complete information.

4. License and Use Restrictions

Step Rival grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for personal, non-commercial purposes. You may not sublicense, distribute, or otherwise exploit the App except as explicitly allowed.

5. User Conduct

You agree not to:

• Use the Service for unlawful purposes or to violate any applicable laws or regulations.
• Post content that is harmful, offensive, obscene, defamatory, or infringes on others' rights.
• Access or use the Service through automated means or disrupt its operation.
• Artificially manipulate step data, HealthKit sources, rewards, purchases, virtual currency balances, leaderboards, battles, races, summons, or any App integrity system.
• Harass, threaten, impersonate, spam, exploit, or abuse other users through profiles, team chat, reactions, friend requests, invitations, reports, or social features.
• Reverse-engineer or modify the App beyond permitted uses.

6. User-Generated Content and Moderation

• Your Content: You retain ownership of any content you post in the App.
• License to Us: You grant us a worldwide, non-exclusive, royalty-free license to host, copy, display, moderate, remove, and otherwise use your content for providing, protecting, and improving the Service.
• Responsibility: You are solely responsible for the legality and accuracy of your content.
• Moderation: We may review, reject, remove, restrict, or preserve usernames, profile images, team content, chat messages, reactions, reports, and related metadata to enforce these Terms, protect users, investigate abuse, or comply with law. We may use automated and human-assisted moderation tools and third-party providers.

7. In-App Purchases

All purchases are processed via the Apple App Store and are governed by Apple's terms. We do not store your full payment card information. Purchases may include consumables, battle passes, no-ads or multiplier benefits, token packs, limited offers, lifetime unlocks, or other entitlements. Purchases are non-refundable except where required by law or Apple's policies.

8. Virtual Items, Currency, Rewards, and Randomized Features

Step Rival may include virtual currencies, tickets, energy, pet food, ore, equipment, profile frames, backgrounds, pets, rewards, and other digital items. These items are licensed, not sold; have no cash value; are not redeemable for money or property; and may not be transferred, sold, or exchanged outside the Service.

We may change, rebalance, limit, revoke, or discontinue virtual items, rewards, drop rates, summons, gacha-style systems, battle passes, stores, or economy rules as needed for gameplay, security, fraud prevention, legal compliance, or live-operations balance. We may withhold or reverse rewards, balances, items, or entitlements obtained through fraud, chargeback, exploit, automation, suspicious HealthKit data, or violation of these Terms.

9. Health Data Disclaimer

Health-related data used by Step Rival is retrieved from Apple HealthKit or motion APIs only with your permission and is used to provide App features such as step sync, goals, leaderboards, teams, battles, races, rewards, and integrity checks. We do not use Apple Health data for advertising or tracking. Step Rival is for entertainment, motivation, and general wellness support; it is not a medical device and does not provide medical advice.

10. Ads and Sponsored Rewards

The Service may show rewarded ads or sponsored reward opportunities. Rewards are granted only after the App and backend confirm eligibility and completion. We may limit, delay, deny, or reverse ad rewards to prevent fraud, duplicate claims, abuse, or technical errors.

11. Intellectual Property

All intellectual property in the App and Services belongs to Step Rival or its licensors. You may not copy, modify, distribute, or create derivative works without express permission.

12. Privacy

Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.

13. Third-Party Services

We may integrate with third-party tools such as Apple HealthKit, StoreKit, Sign in with Apple, Firebase, Google Sign-In, Google Mobile Ads/AdMob, moderation providers, and other service providers. We are not responsible for any third-party platforms or content linked within the App.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR THAT HEALTH DATA DISPLAYED IS COMPLETE OR ACCURATE.

NOT MEDICAL ADVICE: This App is for informational and motivational purposes only. It does not provide medical advice. Consult a doctor before starting any fitness program.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STEP RIVAL IS NOT LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE APP.

OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PRIOR SIX MONTHS, WHICHEVER IS GREATER.

16. Indemnification

You agree to indemnify and hold harmless Step Rival and its affiliates from any claims or damages arising out of your use of the Service, your content, or your violation of these Terms.

17. Governing Law & Arbitration

These Terms are governed by the laws of California, USA, without regard to conflicts of laws.

Before filing a claim, you agree to contact us at support@steprival.net and try to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association under its consumer arbitration rules, except that either party may bring an individual claim in small claims court where permitted. You and Step Rival waive the right to participate in class, collective, representative, or consolidated actions, except where such waiver is not permitted by law.

18. Apple App Store Terms

If you download the App through the Apple App Store, Apple is not responsible for the Service, support, maintenance, warranty, or claims related to the App except as required by applicable law or Apple's terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them as related to your use of the App.

19. Export Compliance

You may not use or export the App in violation of U.S. export laws or applicable regulations in your jurisdiction.

20. Modifications to Terms

We may update these Terms periodically. When changes are material, we will notify you via the App or email. Continued use of the App constitutes acceptance of any revised terms.

22. Users in California, EU/EEA, or Other Jurisdictions

• California: Residents have specific rights under the California Consumer Privacy Act (CCPA/CPRA). Please refer to our Privacy Policy for more details.
• EU/EEA: Residents have rights under the GDPR including access, correction, deletion, portability, and objection. Use the contact info above to exercise these rights.

23. Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy are the complete agreement between you and Step Rival.
• Severability: If any part is found unenforceable, the rest remains valid.
• No Waiver: A failure to enforce any right does not mean we waive it.
• Assignment: You may not assign these Terms. We may transfer them freely.
